1. Agreement to Terms

These Terms and Conditions (“Terms”) govern your access to and use of ezcopilot.com (the “Site”) and any purchase of products from the Site. By accessing the Site or placing an order, you agree to these Terms.

If you do not agree, do not use the Site.

2. Who We Are

3. Eligibility

You must be able to form a legally binding contract to use the Site and purchase products. If you are using the Site on behalf of a business, you represent you have authority to bind that business.

4. Products

We sell physical goods (including laminated aviation checklists) and digital gift cards through the Site.

Some items may be custom/personalized and may require customer-provided information (e.g., tail number, aircraft details, preferences). You are responsible for ensuring information you submit is accurate.

5. Aviation Safety and “Not the POH” Disclaimer (Read This)

Our products are intended to be a cockpit aid and a convenience tool. They are not a substitute for proper training, aeronautical decision-making, regulations, or the aircraft’s official documentation.

To the maximum extent permitted by law:

  1. Not official aircraft documentation. EZ Copilot checklists are not the FAA-approved POH/AFM and are not issued by the aircraft manufacturer.

  2. Verify against your POH/AFM. You are solely responsible for verifying any procedure against your specific aircraft’s POH/AFM and any applicable supplements, STCs, placards, checklists, and limitations.

  3. No guarantee of POH match. We do not guarantee our checklists exactly match any particular POH/AFM revision or configuration, even if a checklist references a make/model.

  4. Pilot in Command responsibility. You (and/or the Pilot in Command) remain fully responsible for safe operation, regulatory compliance, aircraft airworthiness, and proper procedures.

  5. Not responsible for misuse. We are not responsible for any outcome resulting from use or misuse of our products, including if a checklist is incomplete for your aircraft configuration, used incorrectly, or not verified.

6. Pricing, Currency, Taxes

Prices are shown on the Site and may change at any time.

We currently collect sales tax on orders shipped to Florida and may collect taxes in other jurisdictions if required by law.

7. Promotions and Discount Codes

Discount codes and promotions are offered at our discretion and may be modified or ended at any time.

Unless we explicitly say otherwise, promotions and discount codes are not combinable.

8. Orders, Payment, and Authorization

We accept payment methods made available at checkout (including Shopify-supported payment methods and PayPal, as configured).

You are charged at checkout.

We may refuse, cancel, or limit orders at our discretion, including for suspected fraud, pricing errors, inventory issues, or other operational reasons. If we cancel after you have been charged, we will issue a refund to the original payment method.

9. Preorders and Backorders

We may offer items for preorder or backorder.

You may cancel and request a refund any time before shipment by contacting info@ezcopilot.com.

If we cannot ship within the time we promised (or if no time is promised, within the time required by applicable rules), we will notify you and provide options to wait or cancel for a refund, as applicable.

10. No Order Changes After Purchase

After an order is placed, we do not guarantee we can change items, shipping methods, addresses, or apply discounts retroactively.

If you need to cancel before shipment, contact info@ezcopilot.com as soon as possible (see Section 9 and our Returns Policy).

11. Shipping and Delivery

Shipping terms are described in our Shipping Policy (incorporated by reference).

Risk of loss and title pass to you upon delivery to the carrier to the extent permitted by law, except where consumer law provides otherwise.

12. Returns, Refunds, and Lifetime Guarantee

Returns and refunds are governed by our Returns Policy (incorporated by reference).

We offer a lifetime guarantee as described in that policy, with important exclusions (including custom items for “change-of-mind” returns) and condition requirements.

Note: consumer protection laws in some jurisdictions may provide additional rights (for example, EU/UK withdrawal rights), and we do not limit those statutory rights. 

13. Gift Cards

Digital gift cards:

  • Are redeemable only as stated at purchase/checkout

  • Are not redeemable for cash except where required by law

  • May have additional terms disclosed at purchase

14. Wholesale / B2B

We may offer wholesale pricing to eligible businesses. Wholesale eligibility may require a valid reseller certificate and other verification.

Wholesale orders may be subject to separate terms provided during the wholesale approval process or at checkout. If wholesale terms conflict with these Terms, the wholesale terms control for those wholesale transactions.

15. Accounts

If you create an account, you agree to provide accurate information and keep credentials secure. You are responsible for activity under your account.

We may suspend or terminate accounts for misuse, fraud, policy violations, or legal compliance.

16. User Content (Reviews, Photos, Uploads)

The Site may allow you to submit content (such as reviews, comments, photos, or other materials) (“User Content”).

You agree that:

  • You own or have permission to submit User Content

  • Your User Content does not infringe intellectual property rights, privacy rights, or other rights

  • Your User Content is not unlawful, defamatory, abusive, harassing, hateful, obscene, or deceptive

By submitting User Content, you grant EZ Copilot a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, publish, display, and distribute the User Content for operating, marketing, and improving the Site and our products.

We may remove or moderate User Content at our discretion.

17. Intellectual Property

The Site, product designs, branding, and content are owned by EZ Copilot or its licensors and protected by intellectual property laws. EZ Copilot® is a trademark of EZ Copilot, LLC.

You may not copy, reproduce, sell, or exploit the Site or our content except as permitted by law or with our written permission.

18. DMCA Copyright Policy

We respect intellectual property rights and will respond to properly submitted notices of alleged copyright infringement.

If you believe content on the Site infringes your copyright, send a notice to our designated contact at:

Your notice should include the information required by 17 U.S.C. §512 (e.g., identification of the copyrighted work, the material claimed to be infringing, contact information, a good-faith statement, and a statement under penalty of perjury).

If you submit a counter-notice, include the information required by law. We may terminate repeat infringers in appropriate circumstances.

Important note: U.S. law provides additional safe-harbor steps for sites that host user content, including designating and registering a DMCA agent with the U.S. Copyright Office.

19. Disclaimers

To the maximum extent permitted by law:

  • The Site and products are provided “as is” and “as available,” without warranties of any kind except as expressly stated in our Returns Policy/lifetime guarantee

  • We disclaim implied warranties including merchantability, fitness for a particular purpose, and non-infringement to the extent permitted

  • We do not warrant the Site will be uninterrupted, secure, or error-free

20. Limitation of Liability

To the maximum extent permitted by law, EZ Copilot will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or lost profits/revenues, even if advised of the possibility.

To the maximum extent permitted by law, our total liability for any claim relating to a product or the Site will not exceed the amount you paid to us for the specific product(s) giving rise to the claim.

21. Indemnification

You agree to indemnify and hold harmless EZ Copilot from claims arising out of your misuse of the Site, violation of these Terms, or infringement of rights through User Content you submit.

22. Dispute Resolution, Binding Arbitration, and Class Action Waiver

Please read this section carefully.

You and EZ Copilot agree that any dispute or claim arising out of or relating to these Terms, the Site, or products (a “Dispute”) will be resolved by binding arbitration on an individual basis, except that either party may bring a claim in small claims court if eligible.

  • Governing law/venue: Florida law applies, and arbitration will be seated in Orange County, Florida, unless required otherwise by applicable consumer law.

  • No class actions: You and EZ Copilot agree to bring claims only in your/its individual capacity, not as a plaintiff or class member in any purported class, collective, private attorney general, or representative proceeding.

  • Arbitration procedure: The arbitrator may award relief only on an individual basis. The arbitrator’s decision will be final and binding.

If any part of the class action waiver is found unenforceable, the remainder of the arbitration agreement will remain in effect to the extent possible.

23. Changes to These Terms

We may update these Terms from time to time. The “Effective Date” will indicate the latest version. By continuing to use the Site after changes become effective, you agree to the updated Terms.

For material changes, we may also provide additional notice (e.g., by posting on the Site or via email where appropriate).

25. Marketplace Purchases (Amazon/Etsy)

Purchases made through Amazon, Etsy, or other marketplaces are governed by the applicable marketplace terms and policies for payment processing, shipping, returns, and disputes, in addition to any product-specific information shown in the listing.
